Joint International Symposium on U.S. And European Patent Practice

Maiwald and Oblon co-hosted the “International Symposium on U.S. and European Patent Practice 2020” on February 20, 2020 at the Sofitel Munich Bayerpost Hotel in Munich. Together with James Love, David Longo, Dr Daniel Pereira and Andy Ollis from Oblon, our partners Dr Norbert HansenDr Andrea LasarAlexander Ortlieb and Dr Derk Vos led through the event.

During the full-day seminar, current aspects of IP practice related to prosecuting applications and enforcing patents in the U.S. and in Europe were discussed. While similarities exist, applicants for U.S. and European patents need to be aware of the peculiarities and most recent developments in each system in order to achieve the best results. In particular, the symposium addressed the following important topics for today’s practitioners:

  1. Claim interpretation during prosecution and admissibility of amendments – how to understand and navigate in examination before the USPTO and EPO;
  2. US patent drafting tips for computer implemented inventions and EP examination practice on Artificial Intelligence inventions;
  3. US and EP practice on biosimilars and antibodies-related inventions; and
  4. Doctrine of equivalents – recent developments in both jurisdictions.
