A European Unitary Patent and a Unified Patent Court: The EU aims to create a European Unitary Patent with uniform effect in all member states of the European Union. There are still political and legal debates, but no one doubts that the EU Unitary Patent will come one day.
The Unitary Patent has “a multitude of strategic possibilities for obtaining, enforcing or defending patents”, says Sophie Ertl. For patent owners, she says, proceedings before the Unified Patent Court are both coveted and risky: one single proceeding will be sufficient to enforce the patent for all states that will sign the agreement. However, the patent can also be lost in all member states. Therefore, the need for legal advice increases enormously.
