Compliance

The task of compliance is to help businesses minimize the risk of inadvertently violating regulations by adopting timely organizational and preventive measures. If an organization does not have a functioning compliance management system in place, there is always the risk that the management bodies will leave themselves vulnerable to civil, in some cases even criminal, proceedings. Where wrongdoing has already occurred, in order to be able to participate in public procurement procedures it may become necessary to adopt compliance measures aimed at remedying the consequences of the wrongdoing. Maiwald’s attorneys-at-law can advise you in setting up and implementing a compliance management system. This would typically include aspects such as identifying risks, drawing up guidelines and process descriptions, implementing staff training measures and advising on how to identify potential compliance cases (internal investigation). When required, we can put the client in touch with an external compliance expert, or offer advice on where to report compliance concerns (so-called whistleblowing).
