MAIinsight is back with its third edition! This time, the focus is on UPC infringement proceedings. We present exciting articles on the currently evolving frameworks for assessing the risk of first-time infringement and the violation of protection rights for a second medical use. Additionally, there are updates on the decisions G 1/23 and G 1/24 of the Enlarged Board of Appeal of the EPO.

The third edition also takes a look at the EPO’s case law on converging lists. In the field of artificial intelligence, we provide a detailed insight into its use for prior art searches and FTO searches. Finally, the risks and benefits of 3D trademarks, as well as alternative protection options for product shapes, are explored.
