With the AI Act, the EU legislator has set out to establish a legal framework for trustworthy AI. However, a harmonized EU-level regime on AI liability is, for the time being, still outstanding. Against this backdrop, it is crucial to define criteria for determining the applicable standard of care in order to capitalize on the opportunities of AI deployment while minimizing one’s own liability risk as far as possible.
