The The Oblon and Maiwald firms were pleased to host a complimentary joint international symposium on: U.S. and European Patent Practice: Important Aspects for Practitioners

At the 2025 joint symposium, selected current aspects of protecting innovations in the U.S. and Europe were examined, considering both pre- and post-grant perspectives.

In particular, the symposium addressed the following important topics for practitioners:

  • News from the Unified Patent Court: Overview of recent case law
  • Machine learning model deployment invention – a case study
  • EPO Enlarged Board of Appeal decision on prior art status of commercial products – G 1/23
  • U.S. practice regarding beta versions of software as prior art and the U.S. perspective on G 1/23-like cases
  • Open-ended ranges and parameters at the EPO – is the claim reproducible or not?
  • Claiming and disclosing open-ended ranges from the U.S. perspective
