Some practitioners took the view that the UPC also benefits from the so-called \u2018long-arm\u2019 jurisdiction, meaning the court being able to impose remedies relating to acts of infringement of the national parts of European patents in countries that are not in the European Union (EU) but are members of the European Patent Convention (EPC). This could apply for example to countries such as Norway, Switzerland, Turkey and the UK.<br>In its landmark decision <a href=\"https:\/\/www.unified-patent-court.org\/sites\/default\/files\/files\/api_order\/CC5DDB59B23C4060B18ADA327BFB5640_en.pdf\" data-type=\"link\" data-id=\"https:\/\/www.unified-patent-court.org\/sites\/default\/files\/files\/api_order\/CC5DDB59B23C4060B18ADA327BFB5640_en.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Fujifilm v Kodak<\/a>, the D\u00fcsseldorf Local Division of the UPC ruled that it also has jurisdiction over infringement actions concerning the UK part of a European patent.<\/p>\n\n\n\n<p>In this article, we explain the background to and potential impact of this judgment and will comment on the most recent decision from the Court of Justice of the European Union (CJEU) in <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:62022CJ0339\" data-type=\"link\" data-id=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:62022CJ0339\" target=\"_blank\" rel=\"noreferrer noopener\">BSH Hausger\u00e4te vs. Electrolux<\/a>, which \u2018confirms\u2019 the D\u00fcsseldorf approach and thus the greater powers of the UPC, but also expands on it with respect to national courts and patents in non-EU countries.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"template":"","meta":{"_acf_changed":false,"footnotes":""},"class_list":["post-48966","publikationen","type-publikationen","status-publish","hentry"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.maiwald.eu\/ko\/wp-json\/wp\/v2\/publikationen\/48966","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.maiwald.eu\/ko\/wp-json\/wp\/v2\/publikationen"}],"about":[{"href":"https:\/\/www.maiwald.eu\/ko\/wp-json\/wp\/v2\/types\/publikationen"}],"version-history":[{"count":2,"href":"https:\/\/www.maiwald.eu\/ko\/wp-json\/wp\/v2\/publikationen\/48966\/revisions"}],"predecessor-version":[{"id":49017,"href":"https:\/\/www.maiwald.eu\/ko\/wp-json\/wp\/v2\/publikationen\/48966\/revisions\/49017"}],"wp:attachment":[{"href":"https:\/\/www.maiwald.eu\/ko\/wp-json\/wp\/v2\/media?parent=48966"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
