Among other things, the question of to what extent a FRAND dispute should and can be heard and, if necessary, decided before an arbitration court and\/or in the course of mediation proceedings is dealt with in detail. To this end, the guidelines point out various options under which the parties can choose &#8211; if necessary in consultation with the arbitral tribunal or mediator &#8211; and thus ensure that the arbitral tribunal and\/or mediator has clear competence. In addition, general points on possible submission agreements and procedural orders are addressed.
