In the article &#8220;Der patentrechtliche Verh\u00e4ltnism\u00e4\u00dfigkeitsgrundsatz im Bereich Arzneimittel und Medizinprodukte, Teil 1 &#8211; Einf\u00fchrung, die Ber\u00fccksichtigung von Drittinteressen und kritische Auseinandersetzung mit der SOFOSBUVIR Entscheidung&#8221; by <a href=\"https:\/\/www.maiwald.eu\/en\/team\/marco-stief\/\">Dr Marco Stief<\/a> in the current issue of PharmR 2\/2023, two major innovations in particular are explained. The objection of disproportionality newly inserted in Sec. 139 (1) sentence 3 Patent Act and the compensation claim inserted in Sec. 139 (1) sentence 4 Patent Act.
