If an organization does not have a functioning compliance management system in place, there is always the risk that the management bodies will leave themselves vulnerable to civil, in some cases even criminal, proceedings. Where wrongdoing has already occurred, in order to be able to participate in public procurement procedures it may become necessary to adopt compliance measures aimed at remedying the consequences of the wrongdoing. This would typically include aspects such as identifying risks, drawing up guidelines and process descriptions, implementing staff training measures and advising on how to identify potential compliance cases (internal investigation).
