Dezember 2022 (Az. I ZR 144\/21) hat der Bundesgerichtshof (BGH) mehrere wichtige Punkte klargestellt, auf die <a href=\"https:\/\/www.maiwald.eu\/de\/team\/christian-meyer\/\">Dr. Christian Meyer<\/a> in seinem Beitrag genauer eingeht. Erstens, dass die Abgabe einer strafbewehrten Unterlassungserkl\u00e4rung auch nach einem zweiten Versto\u00df durch ein Vertragsstrafeversprechen nach dem sogenannten Hamburger Brauch erfolgen kann.
